TERMS OF SERVICE AGREEMENT FOR VISBETS

INTRODUCTION; ACCEPTANCE OF TERMS

Binding Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and VisBets LLC ("VISBETS," "we," "us," or "our"), governing your access to and use of the VISBETS mobile application (the "App") and related services. By registering, accessing, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to any provision of these Terms, do not use the App.

Not a Sportsbook or Gambling Platform

VISBETS is a data and analytics tool for sports bettors, focusing exclusively on the National Basketball Association (NBA). VISBETS is not a sportsbook, does not accept or handle bets or wagers, does not hold or transfer user funds, and does not facilitate, promote, or enable gambling or sports betting transactions of any kind. Users must place any actual bets through separate, unaffiliated third parties (such as DraftKings, FanDuel, etc.), entirely independent of VISBETS.

ACCOUNT REGISTRATION AND ELIGIBILITY

Registration

To access certain features of the App, you must create a user account using a valid email address and password. Authentication is managed by Supabase and passwords are immediately hashed; VISBETS never receives, stores, or accesses user passwords in plain text.

Age Restriction

You must be at least twenty-one (21) years old, or the legal age of majority in your jurisdiction, whichever is higher, to access or use the App. By registering or using the App, you certify that you meet the required age. VISBETS strictly prohibits use of the App by minors. VISBETS reserves the right to terminate access for any User believed to be under the required age.

Legality in User's Jurisdiction

You are solely responsible for determining and complying with all federal, state, and local laws and regulations applicable to sports betting and the use of sports analytics information in your jurisdiction. VISBETS makes no representation regarding the legality thereof.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify VISBETS immediately if you suspect unauthorized access.

RESPONSIBLE GAMBLING AND USER OBLIGATIONS

Responsible Gambling Policy

VISBETS advocates responsible gambling and discourages betting more than you can afford to lose. For support, contact the National Problem Gambling Helpline at 1-800-GAMBLER or refer to additional resources provided in the App and on the VISBETS website.

User Risk and Discretion

All analytics, predictions, and information provided by the App are for informational and entertainment purposes only. You are solely responsible for any decisions you make based on this information, including the placement of any bets on third-party services.

No Guarantee of Outcomes

VISBETS does not, and cannot, guarantee the accuracy, profitability, or success of any outcome, prediction, or data provided through the App.

SUBSCRIPTIONS, PAYMENTS, AND BILLING

• VisPlus/Starter (monthly or annual)
• VisMax/Pro (monthly or annual)

Payment Processing

All payments and subscription activations, renewals, and upgrades are exclusively managed and processed by Apple via In-App Purchase. Subscription status (activation, verification, and renewal) is managed through RevenueCat. VISBETS does not access, receive, or process your payment card, billing, or banking information.

Auto-Renewal

Subscriptions automatically renew at the end of each term (monthly/annually) unless canceled by you through your Apple account settings prior to the subscription renewal date. You are responsible for managing, amending, or canceling your subscription preferences directly via your Apple ID under your device's account management settings.

DATA PRIVACY, SECURITY, AND THIRD-PARTY PROVIDERS

Privacy Policy Incorporated

The collection, use, retention, and disclosure of your personal information is governed by the VISBETS Privacy Policy (as updated from time to time), which is hereby incorporated by reference. By consenting to these Terms, you acknowledge that you have read and agree to the Privacy Policy.

Security Measures

VISBETS maintains commercially reasonable technical, organizational, and physical safeguards to protect your information. Passwords are hashed; connections use secure protocols (such as HTTPS); only authorized personnel may access personal data.

INTELLECTUAL PROPERTY; USER LICENSE

Ownership

Except for content openly attributed to third parties and subject to their respective licenses, all content, code, analytics, models, data compilations, trademarks, service marks, and branding within the App are the exclusive property of VISBETS LLC.

Limited License

VISBETS grants you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the App strictly for lawful, personal, and non-commercial purposes, in accordance with these Terms.

DISCLAIMERS AND LIMITATIONS OF LIABILITY

No Sportsbook; No Bets or Wagers

VISBETS is not a sportsbook, gambling operator, or wagering facilitator. The App does not accept, process, or settle any bets or wagers; does not hold or transfer user funds; and does not require or claim to hold any gambling license.

Predictions and Data as Estimates Only

All information, predictions, analyses, and odds provided via the App are intended for informational and entertainment purposes only, and are based on statistical modeling and third-party data. VISBETS does not guarantee the accuracy, completeness, profitability, or outcome of any prediction, analysis, or data.

Assumption of Risk

User assumes all risks, known or unknown, associated with the use of the App, including but not limited to any financial losses incurred through third-party betting platforms based on Data, models, or predictions provided by VISBETS. User accepts full responsibility for any claims or financial losses they may suffer arising from or related to their reliance on the App.

TERMINATION AND SUSPENSION

Termination by VISBETS

VISBETS may, at any time and in its sole discretion, suspend, restrict, or terminate your access to the App and/or your account for any reason, including but not limited to violation of these Terms, suspected fraud, unlawful activity, account inactivity, or as required by law, without prior notice.

Termination by User

You may terminate your account at any time by following the instructions within the App or contacting privacy@visbets.com. Account termination will be effective after applicable processing by VISBETS, subject to data retention requirements.

ACCESSIBILITY AND AVAILABILITY

Accessibility Commitment

VISBETS is committed to providing equal access to its App and these Terms for all users, regardless of disability. These Terms are provided in a format compatible with commonly available assistive technologies and comply with recognized accessibility standards (e.g., WCAG). Users may request these Terms or related notices in alternative formats by contacting privacy@visbets.com.

MISCELLANEOUS

Governing Law; Jurisdiction

These Terms and any dispute or claim arising out of or in connection herewith shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You consent to exclusive jurisdiction of the courts located in San Francisco County, California.

Entire Agreement

These Terms, together with the Privacy Policy and any referenced policies, constitute the entire agreement between you and VISBETS regarding your use of the App and supersede any prior agreements or understandings relating to the same subject matter.
