VISBETS LLC MESSAGING AND SMS OPT-IN AGREEMENT

Introduction and Purpose

Agreement Scope

This Messaging and SMS Opt-In Agreement ("Agreement") governs your election to receive text messages, SMS alerts, and other forms of electronic communications ("Messages") from VisBets LLC ("VisBets," "we," "us," or "our") through or in connection with the VisBets mobile application and related services (the "App" or "Service").

Acknowledgement of Purpose

By affirmatively consenting as described herein, you authorize VisBets to send you Messages for informational, administrative, transactional, and account-related purposes, including (but not limited to) updates regarding your account status, subscription management, technical alerts, important service notifications, legal disclosures, responsible gambling resources, and communications relevant to your use of the App.

Non-Gambling Business Model

VisBets is not a sportsbook, does not accept bets or wagers, does not handle user funds, and does not facilitate or promote gambling. All Messages are strictly related to service communications, analytics offerings, and responsible gambling notices, not advertisements for or inducements to gambling or wagering.

Consent to Receive Electronic Messages

Express Consent Requirement

By providing your mobile telephone number and affirmatively opting in (by checking a box, clicking "I Accept," replying YES to a prompt, or by other clear affirmative action), you expressly consent under the Telephone Consumer Protection Act ("TCPA"), California Consumer Privacy Act ("CCPA"), and related federal and state laws and regulations, to the receipt of Messages from VisBets at the number provided, including via automated dialer or pre-recorded format, where permitted by law.

Nature and Frequency of Messages

Messages may include account status, subscription renewals, transactional updates, password resets, responsible gambling information, and critical service notices. We will not send unsolicited promotional or advertising content for third-party products or services. The volume of Messages may vary, but you may receive up to 8 messages per month depending on your usage and subscription preferences.

Consent Not Condition of Use

Your consent to receive Messages is not required as a condition of purchasing or using the App or any VisBets service. You may use the App without consenting to receive marketing or informational text messages.

Opt-Out and Revocation of Consent

Opt-Out Mechanism

You may revoke consent and opt out of receiving Messages at any time by replying "STOP" to any SMS Message received from VisBets. Upon receipt of your opt-out request, VisBets will send a text confirmation of your opt-out status and will promptly honor your request (generally within one business day).

Alternative Opt-Out Methods

You may also opt out by contacting VisBets via in-app settings (Account > Privacy & Notifications > Messaging Preferences), emailing privacy@visbets.com, or mailing a written request to VisBets LLC, Attn: Messaging Opt-Out, 1234 Analytics Ave, Suite 100, San Francisco, CA 94016.

Help Requests & No Additional Charges

For assistance, reply "HELP" to any Message or contact privacy@visbets.com. VisBets does not charge a fee for sending or receiving Messages; however, message and data rates may apply from your mobile carrier. You are solely responsible for any carrier charges incurred as a result of participation.

Data Collection, Use, and Retention; No Sale or Sharing

Collection and Use of Information

VisBets collects and uses your mobile number and limited device and app usage information for the sole purpose of facilitating Message delivery and supporting your account, in accordance with the VisBets Privacy Policy.

Non-Sale/Non-Sharing Commitment

VisBets does not sell or share personal information collected for messaging purposes with any third party for commercial, cross-context behavioral advertising, or gambling-related marketing purposes, as defined under CCPA/CPRA and other applicable law.

Rights of California Residents

California residents may request to know, correct, or delete their personal information at any time via privacy@visbets.com or the in-app Privacy Request form.

Age Restrictions and User Certification

Legal Age Requirement

The App and associated services, including the receipt of Messages, are intended only for individuals at least twenty-one (21) years of age (or the age of majority in your jurisdiction, if higher). By opting in, you certify that you meet this requirement.

Prohibition for Minors & Parental Consent

Individuals under the required age must not use the App or opt in to receive any Messages. VisBets strictly prohibits minors from opting in. In the event we discover a minor has inadvertently opted in without verifiable parental consent, we will immediately revoke consent, terminate access, and delete associated personal information in compliance with the Children's Online Privacy Protection Act (COPPA) and similar laws.

Responsible Gambling Notice

VisBets provides access to responsible gambling resources and encourages users not to wager more than they can afford to lose. For support, contact the National Problem Gambling Helpline at 1-800-GAMBLER.

Disclaimers, Responsible Use, and Legal Notifications

Not a Sportsbook or Gambling Operator

VisBets is not a sportsbook, does not accept bets or wagers, and does not hold or process user funds. Messages from VisBets provide analytics, predictions, and information for educational, informational, and entertainment purposes only.

No Guarantee of Outcomes

All projections, predictions, and analytics are estimates and do not guarantee any results regarding sports outcomes or wagering.

Security, Recordkeeping, and Notification

Security Measures & Recordkeeping

VisBets implements industry-standard technical, physical, and organizational measures to safeguard the confidentiality and integrity of information. VisBets maintains logs of user opt-in and opt-out actions for compliance, audit, and dispute resolution purposes.

Data Breach Notification

In the event of an unauthorized acquisition or breach of your personal information associated with Messages, VisBets will provide prompt notification in accordance with applicable state and federal law, and will take all legally required remedial actions.

Governing Law and Dispute Resolution

This Agreement shall be governed and construed in accordance with the laws of the State of California and applicable federal law. Any dispute or claim arising out of or relating to this Agreement, communications, or the use of Messages shall be subject to the dispute resolution and venue provisions contained in the VisBets Terms of Service.

By affirmatively opting in to receive Messaging and SMS communications from VisBets, you acknowledge that you have read, understood, and agree to be bound by the terms of this Messaging and SMS Opt-In Agreement, as well as the VisBets Privacy Policy and Terms of Service.
